The Law Association of Zambia (LAZ) says time to appeal in the Fredrick Chiluba plunder cases has lapsed.
Former president Chiluba was acquitted on all counts of corruption charges by a magistrate court after seven years of going to court.
LAZ president Stephen Lungu told a media briefing in Lusaka Tuesday afternoon that even though that was the case, LAZ has written to the DPP to seek audience over the matter owing to public interest in the case.
Lungu explained that LAZ feels that there are sufficient grounds for the director of public prosecutions (DPP) Chalwe Mchenga to appeal against the acquittal of former president Fredrick Chiluba.
He said looking at the possible grounds of appeal provided by prosecutor Mutembo Nchito, LAZ is convinced that the appeal would be viable.
He however defended the decision by the DPP not to appeal saying Zambian the constitution vests power in the DPP whether to appeal against a case or not.
And Lungu has warned of serious penalties against any of its members issuing statements against the Judiciary in the media.
He says public attacks against the Judiciary by lawyers may diminish public confidence in the legal profession.

Yes, the DPP has the power to discontinue a case but in this instance, he was compromised since he pandered to the whims of those in power. The only reason chiluba is not getting arrested is because it has been deemed to be politically inconvenient. When did jail become a place for just ordinary citizens? Let us just forget and move on, why are some people so determined to see Chiluba jailed? What difference will it make, this is a former President of the current ruling party. To jail Chiluba, one has to jail all MMD members especially those who served under Dr. Chiluba. But we all know that won’t happen so why make a big thing out of nothing. It seems the Post have nothing to write about since Chiluba is free, that is what this is all about. Fred Mmembe and his henchmen thought they had it all under control but Bwezani outsmarted them. RB knows that if he jails chiluba today, tommorow it will be him so he won’t let it happen. Zambians must stop dancing to the tunes of the Post because as far as I am concerned, the Post have serious issues, the think they are the gov’t like all things have to be done according to them. 17 years of publishing trash has really gone to fred membe’s head. Times are changing.

Attitudes like yours have made our nation what it is now. How long are you going to keep moving on leaving a chain of uncorrected wrongs???As you rightly put it, today its Chiluba, tomorrow it will be Banda and so on and so forth, they all steal we leave then and keep on moving on. No my man, a wrong is a wrong and the culprits need to be punished so that they pay back for what they have stolen and it serves as a lesson to would be leaders that crime does not pay.
Chiluba is now saying he is a pastor , a pastor to preach about his innocence . I don’t think its his will to try to convince people to believe that he is innocent . They say sweeter coating bitter truth will not sweeten it, everyone all over the world knows that Chiluba to some extent abused public funds . Its only in our useless countries like Zambia where such people like Chiluba go scot free . Taiwan ,Peru etc all these countries have their former PMs or Presidents locked because of the same abuse of office . Why is Zambia trying to be different on this issue , what benefit will this bring to the country apart from scaring away donors and investors? I have a big issue with my superiors over the investment we want to put in Zambia because they feel their investments are not protected due to lack of transparency in leaders and too much corruption . People who are not Zambians can’t understand how stupid we Zambians are. What RB should have done is to have Chiluba convicted then pardon him at a later stage on grounds of him having been a former president , but where they say he is innocent it really doesn’t help.
Lungu you are a let down and should step aside so that those that can steer LAZ effectively take over. Today you are defending DPP when you know that the law has been trampled on. Why is this DPP afraid of apealing ? This is the $1m question !

FTJ was taken to the london court over corruption by the late LPMs who died after a reoccurrent brain stroke, He was found guity by the late Judge smith who died of a heart attack, the case was being registered in the zambian courts by the late judge Japhet banda who died in a road accident, at the time of these events the chief of police who was a member of the task force by virture of his office was Wazakaza nguni, he died in a road accident. Its not clear which judge is currently handling the matter if any. President chiluba is a former president and an evangelist, he has repeatedly pronounced that he is a prophet standing on solid rock and that whoever fights his Godly ways shall be crushed. After his aquital on charges of corruption he was issued with a certificate of aquital the following working day. without consent from the DPP the task force head announced on Muvi TV that he has filed an appeal. The appeal was immediately withdrawn by the DPP’s office and Mr Nkole’s expired contract was never renewed and had to vaccate office the following day.As of today Mr Chiluba is still Challenging the legality of the task force and is persuing Mr Nkole to be a witness in the case or face undisclosed charges.True to his word FTJ seems to be standing on solid rock legally and politically. The unions are already showing signs of siding with him(if Hikaumbas words are to go by) and the opposition strongholds are slowing drifting to the former presidents side. Indeed a very very caurageous Judge is required for for this case!!

LAZ you are part to this DPP saga. You should have doen this earlier. You well know that an appeal has a time frame in which to appeal, but you couldnot do what you are doing now early. This means your hands are not clean at all. WHO DOES NEED MONEY ANYWAY? MR LUNGU LAZ PRESIDENT? MMD is spending money in Kasama and also on Lawyers,the entire Judiciary etc. The System is rotten to the ass.

I fail to understand we Zambians! A wrong was committed and today you have someone talking ill about the post newspaper. Friends without the post newspaper this country would have been sold by now! If Chiluba had just kept quiet maybe things would be different. I strongly feel the LAZ should come out and take a serious stand on the aquital. A word of caution to those bad mouthing the Diplomats. Zambia always has a defecit on the national budget. Where are you going to beg from? The chocholees?
When is the Law Association of Zambia going to get its act together and reign in on its members? Ever since some quasi-journalists became lawyers, the LAZ has become a laughing stock! Judges are maligned by the very same members of the profession who will be bringing cases before them. Does not that amount to intimidation and bullying of the bench? LAZ is failing to protect the honour and integrity of the judiciary. Indeed, it is the ‘thief who is protecting the policeman!’ Mr Lungu and his team need to get their act together and begin to seriously think of disbarring some members of his profession who are bringing it into disrepute. Chief among them is Ludwig Sondashi! One cannot imagine a case in which medical practitioners criticise each other through the public media about the managemnet of a patient’s condition! In the same manner, the clegy in Zambia are also mis-behaving. This is anarchy and it MUST stop!
