Siliya’s abuse of authority case to be heard in 2010

The appeal in the case where  education minister Dora Siliya was cleared of charges of abuse of authority by the high court will be heard in 2010. Siliya was communication minister when a tribunal was set up to investigate allegations of abuse of authority on her part.

Former communication minister William Harrington was not satisfied by judge Phillip Musonda’s decision to clear Dora Siliya of abuse of authority of office charges and appealed to the Supreme court.

Harrington contends in the supreme court that the High Court judge erred in law and fact when it used judicial review proceedings as an appeal process by delving into the merits of the tribunal’s findings.

But the  Supreme court has set January 14, 2010 as the date for hearing saying the matter will not be among the cases to be heard in the Supreme court session that will be in Kabwe.

    Chicago your coments shows how low you are in thinking and I wonder what you use to think or what is inside what you call your head. You are the people we do not need anywhere near our beloved country. If you have nothing to do I suggest you offer your body for research work in some medical research institute than presening such hateful comments. The issue here is what the courts have said and we should respect our courts if we are to develop trust in them. Princpled men will never be compromised and I believe we have such in the judiciary. What we need to understand is law has got its way of dealing with cases and not our logic (in this case for chicago his is warped) or what we think should be the out come.

    Harrington is wasting the courts time.Their is absolutely no possibility of him gaining political mileage over this thing. judgement was read and its dead and barried. the next case to follow and prepare appeals now is Chansa Kabwela and Membe’s cases thats where the chance of political mileage is.

    Sorry folks, the judiciary has become a weak institution and it gives unpredictable rulings. Case in point: Chiluba (not guilty), Regina (guilty) – how? Since RB came into office, the judiciary’s uselessness has been revealed. Unfortunately, I no longer have faith in our justice system. It is not based on laws but on persons!

    Chicago, I do not agree with you. It is probably you who has a problem – TRIBALIST. The Chief Justice was put there by LEVY in the first place. Why do you see problems in every direction. How many Bembas or any other tribe have headed institutions??

    I would have a problem if you said that The Chief Justice is NOT qualified. People should be appointed to positions based on qualification and not where they come from.

    The problem in Zambia is 1.the executive is headed by an easterner 2. Judiciary too is headed by an easterner. This has compromised these bodies. KK ensured that different peoples headed this critical institutions. Look at LAZ they are finished!
