The merits of the case were delved into by the solicitor general prematurely as rightly pointed out by Mr. Shonga .Be that as it may the threshold test applied by the court when considering the exparte application for leave to move the court for judicial review remains satisfied upon considering the present application. I therefore dismiss the application with costs.
