A number of civil society organisations in Zambia have joined those that are opposed to the lifting of former president Rupiah Banda’s immunity.
The Civil Society for Poverty Reduction (CSPR) in Eastern Province has described calls to remove the immunity of fourth Republican President Rupiah Banda as a serious violation of the rule of natural justice.
CSPR Provincial Coordinator, Maxwell Nkhoma says the organization finds calls to remove Mr Banda’s immunity as premature because there is no evidence of corruption against him.
Mr Mwale explained that CSPR strongly believes that the Anti-Corruption Commission (ACC) and other law enforcement agencies have not done enough up to this stage to show causes why the immunity of Mr Banda should be removed.
Mr Nkhoma said that there is need for law enforcement agencies to provide evidence to the public showing wrong doings by Mr Banda while he was in office.
CSPR has also demanded updates on investigations involving Justice Minister, Wynter Kabimba and Defence Minister, Geoffrey Mwamba on alleged corruption if equality before the law is to be seen.
The Non Governmental Organisation Coordinating Committee (NGOCC), Foundation for Democratic Process (FODEP) and the Southern Centre for Constructive Resolution of Dispute (SACCORD) have all opposed the lifting of president’s Banda’s immunity.
And Eastern province MMD MPs serving in Sata’s government are also opposed to the lifting of former president Mr. Banda’s immunity.
MMD Provincial Secretary, Samuel Lugomo Phiri told ZANIS in interview that Mkaika constituency MP David Phiri, Kapoche’s Nicholas Banda and Nyimba constituency MP Forrie Tembo have continued to follow the party’s guidelines and do not support some of the ideas of the PF government, such as the lifting of immunity of former President, Rupiah Banda.
So far only the PF compromised mercenaries at the not so Transparent International Zambia (TIZ) have called for lifting of Mr. Banda’s immunity even before a case is established against him.
In an effort to divert attention from Sata’s failures and illness, the Post newspaper and their cartel have launched a campaign for the removal of Mr. Banda’s immunity.

When the issue of lifting Chiluba’s immunity came up in 2002/3, Mwanawasa addressed a press conference at which he accused him of abuse of the ZAMTROOP account. He went on to read out the names of people who benefited from the various payments which were done. The names read out included Matthews Ngulube the Chief Justice then, VJ, ETC. From there civil Society Organizations did the lobbying part at Parliament buildings.
Can Mr. Sata do the same for RB.

I agree that RB’s immunity should be removed. You can’t talk about evidence now and I believe the investigative organs do have the evidence but they do not want it in the public domain for obvious reasons.
Most likely what will happen is that when the motion is moved in prliament, all the reasons will be brought to the fore, as it was with Chiluba when the late Levy Patrick Mwanawasa (SC) made those dramatic revelations to have Chiluba’s immunity removed.
Also, failure to remove RB’s immunity will leave a very bad precedent…..that we are condoning corruption, that it is okay for leaders to abuse their positions for personal gain at the expense of the poor and that we are not serious with the law and the fight or committment to rid the scourge of corruption is but a pipe dream and fake promise.
We had better get serious and create a better Zambia for the future generations.

Zambians under the PF are bound to set a very traumatizing precedence that will have no regard for office of president as an institution.
Fellow Zambians, can we for once be magnanimous and allow ourselves see beyond RB and have regard for the Presidency as an institution because individuals that occupy that position will always come and go.

Should Sata also expect his immunity to be lifted when he leaves office?
The office of president is the highest office of the land and it must be held in high esteem by everyone even those that have personal scores to settle with Sata and RB and his children.
Mind you Sata has children and relatives that are doing business both in Zambia and abroad. These must not be de-franchised for the fear of being pursued by the next government.
RB must be allowed to continue enjoying his immunity and let the PF and all investigative organs of government have tangible and indisputable evidence before they embarrass themselves.
Attorney General must advise government to conduct business in a professional manner.
