LAZ urges ACC to deal with Kabimba firmly, doubts seriuosness of probe

The Law Association of Zambia has been inundated with requests from various stakeholders to comment on the alleged investigations by the Anti-Corruption Commission (ACC) of the two members of the Executive namely Hon. Wynter Kabimba and Hon. Geoffrey B. Mwamba. We as an Association have not commented on the matter in order to allow the ACC to carry out its work without undue influence. However, we were at the outset sceptical at the genuineness of the investigations considering that the two were serving cabinet ministers. We however, hoped that the ACC would act professionally.

The recent events surrounding this so called investigation are making us lean towards a view that the whole process is a masquerade by the ACC and the government to hoodwink the public that the government is investigating the two Ministers in an attempt to convince the public that Government is serious about the fight against corruption

The behaviour of the Hon. Minister of Justice in firstly writing to ACC to demand for a report, secondly to threaten to sue them and lastly to refuse to be interviewed in the absence of his sympathisers or PF Party cadres is a mockery of the justice system and has only served to undermine the criminal justice system.

The Minister of Justice being at the helm of the justice system in the country should be the last person to display the kind of behaviour broadcast in the press yesterday. As a lawyer, the Minister need not be reminded that he swore an oath to defend and protect the constitution and this includes respecting law enforcement agencies. It has always been the practise that suspects are interviewed in the presence of their lawyers and not party cadres or sympathisers. We fail to see why the Minister should demand to be treated differently.

It is clear to us that for as long as the Hon. Winter Kabimba and Hon. Geoffrey Bwalya Mwamba remain in their positions it will not be possible for the ACC to carry out their investigations independently

Accordingly, if indeed there is a serious fight against corruption, we call upon the Republican President as appointing authority to send the two Ministers on Leave until the investigations are concluded.

We further demand that the ACC act firmly in dealing with suspects no matter what position they hold. The ACC have clearly acted unprofessionally in dealing with these matters and this selective type of treatment must stop with immediate effect. We doubt they would have allowed that kind of behaviour had it been from an ordinary member of the public

At the same time the ACC are urged to act speedily and professionally to conclude their investigations because the longer an investigation takes the more damage is done to one’s reputation should one be eventually exonerated.

The minister missed a point by going to the ACC with cadres a wise man learns from past mistakes. Let us hope he will do the right thing next time I think he regrets that time was wasted during his visit to the ACC with cadres because interviews were not done.
The ACC is not for politicks but impotant administrative matters where cadres and their youths have no role to play unless it is about them.
In this case it is the minister`s issue. Please NO! NO! NO!cadres on serious issues about national leaders such as the minister of Justice.
    CADRES KEEP AWAY!!!!!!!!!!!!!!!!

My advise to all leaders, heads of organisations, please never kongola kaloba, drink beer or smoke cigas with workers under your supervision pa last you will go to the toilet together and undress before your juniors, once you do that, you have dug a very big grave for yourself cos you will never instill any displine to your jnrs which will be taken serious. Try by all means to keep distance if it is a credit let the juniors come to you for help and never involve your self or your juniors in any corrupt activities for you to gain something out of their corruption. Stay away from their deals by so doing you will find governancy to be very easy. Once you flock together you are birds of the same feather and no bird obeys the other bird full stop.

Kabimba should step down to pave way for investigation. Its not lawful to probe an individual while holding office. President Sata should learn to listen let him just suspend or even dismiss him for justice purposes, i wonder if the state has concret disciplinary procedures. The law should take its course.

Hello guys the point is that The president could be also involved in the deal. Doesn’t this smell a rat. he has failed to fire Wynter becuase wynter was just a pipeline to the deal. the actual consunser is Sata. He can’t fire GBM because GBM knows everything.

I challenge Sata if he is not involved to come out in the open and fire these ministers. As a public member and Zambian i employ LAZ, NGOCC, HH and Chipimo to dig deeper into this saga of Tafigura oil dear more is hiden.

It will still be difficult to freely interview the Minister if what has been suggested by the law association of Zambia, of sending the two Ministers on leave, is done. This is because the two are bound to come back from leave and still occupy their positions later.

kabimba is a dull moron….very pompous for nothin for nothin chap, the silly fool overate himself…..

Is it not obvious by now that the justice department, judiciary, the police service and even the military have been corrulted to serve those that are in GOvernment and not the people of zambia. I like when such happens as it demonstrate how partial these departments are when dealing pf political opponents and those not affiliated with pf.

  11. Proper Fools  December 5, 2012 at 07:51

Kabimba must resign. The chap is suffering from psychosis due to HIV complications. He is not fit to hold the office of Justice Minister. Look at the way he was sweating. i suspect he has cryptococal Meningitis/TB meningitis/ Viral meningitis. he needs to be evacuated as soon as possible otherwise we are losing him very very soon.

  12. Proper Fools  December 5, 2012 at 07:44

Wynter Kabimba is a very useless Political leader. This chap does not deserve to be a Justice minister. what he did was tantamount to obstruction of justice and thus he was suppose to be charged. the chap is too pompous. i think HIV virus is hitting had. anyway his days are numbers. the chap is running mad. the HIV virus has now damaged his brain

sata is a bad leader indeed. he is just eating whilst his wicked ministers and relatives are misbehaving.

  14. Some-Of-Us  December 5, 2012 at 07:27

When the ACC announced they’d be investigating the two senior officials, Wynter’s reaction was to assure the ACC of co-operation. Now I’m sure he will insist that he never made such an assurance. Alternatively he will insist he was quoted out of context. Or he will insist that in legal terminology, co-operation means exactly what he did at the ACC offices.
