PF loses another electoral petition and told to pay winner Lungwangwa

The Lusaka High Court has thrown out  the Nalikwanda Constituency electoral petition by the Patritic Front.

Judge Flavia Chishimba has declared that MMD Nalikwanda Member of Parliament Geofrey Lungwangwa was duly elected.

Judge Chishimba has dismissed with costs the electoral petition filed losing PF candidate Maurice Munembo.

This means that the PF official will have to pay Lungwangwa’s lawyers plus his own lawyers

She noted that Mr Munembo has not sufficiently shown evidence that Professor Lungwangwa engaged in bribery to woo voters.

Judge Chishimba has also said there was no evidence on allegations that Professor Lungwangwa had used the Constituency Development Fund to buy gifts that were allegedly distributed to would be voters.

    IT IS TRUE THAT PETITIONS ARE A WASTE OF TIME AND MONEY FOR SURE. BUT SOMETIMES THEY ARE GOOD YOU KNOW. IT IS GOOD TO TEST THE POPULARITY OF SOME PEOPLE WHO LIKE TO BLA..BLA..LIKE HH. WE WANT TO SEE IF NOW THEY HAVE BECOME POPULAR IN ANY OTHER PLACES THAN S-P. MAY BE THEY MAY SHUT UP.

    @peace maker, Suntwe, Yonah hara.

    I missed your articles guys, i don’t see any advise in your postings, you are just hitting bak @ me with insults, you call me tribalist and mad person which is in your own opinion it’s okay with you, but you terribly fail to advise your own brothers calling us Kolwestan and insulting your presindent nearly everyday, my coment was just on the fair judgement from our courts and i also wanted the critics of PF to do the same when it is in favour of PF.there is nothing like jealous but these pipo mentioned are the ones critising, insulting and opposing everything our GRZ is doing, I hope we shall all change for the better.

    Sata knows very well that his PF can not win in western province, wait for the eastern and central judgements and see how the judiciary has been directed to nullify a minimum of 12 results and Kabimba.Mangani and others are busy on the ground campaigning in the name of re-organising the party

    @Real Zambia,
    You need to go for examinations at Chainama hospital without any further delays. If you lucky and your mindset is due to the drinks you had with Miles Sampa, the doctors will refer you to the Levy Mwanawase hospital otherwise you need a ward at the Chainama hospital.
    We can’t allow this type of blogging from a sane person. I propose you go on your desk and read Namakando’s Post newspaper so that you talk about Rupiah and how smart Sata has become. Just advise the King thou that we still have free dental services in the country. A few minutes visit might reduce the potent of the vernon

    I hope Munembo will be bankrupted by the legal bills. He is a traitor to have stood on PF ticket. Munembo nemba tuwe ukaise!!

  7. Suntwe  March 1, 2012 at 07:02

    @Real zambian. You really sound a Kolwestan tribalist. What has this story to do with our brothers and sisters who ‘chase cows day and night’ as you have put it. Are jealous about their riches? Do not expose your ignorance publicly. By the way who told you that cows produce faeces? Let me educate you. They produce ‘dung’

    These judgements in petition most of the ongoing petitions should not influence people in believing that the judiciary in Zambia is independent of political influence and judging by the frivolous grounds Patrick Mwanawasa was relying upon in his petition one should be able to see that even a biased court would almost be compelled to rule against the petitioner. In addition, the Courts in Zambia want to be seen to mete impartial judgements therefore it is a matter of “ruling party give me something to base my judgement on and you win the case”. So far most petitions were instigated because the losing PF candidates strongly believed that with Sata and PF in Govt, the courts would be compelled to rule in their favour irrespective of the strength of the claims. Some were so audacious that they even claimed that the winning candidate broke electoral rules by claiming “there would be war if PF was voted into power”. Judging on what has transpired thus far, one would agree that their were not far of in there pronouncements.

    Its interesting how bloggers on this website think. Had this ruling gone the other direction, they would have looked at judge chishimba, pf and made a tribal connection while insulting the president’s interference. Now that pf has lost the petition courtesy of judge chishimba, their talk is that they have staged this to show that they dont interfer. I mean seriously! What stupidity is this? Can we all agree that what we witnessed last year were the most extravagant campaigns by the ruling party ever seen in this country. So why shud it surprise anyone that we have seen the most election petitions ever? If upnd had been successfully petitioning, i wonder which direction opinion of these bloggers wud have swung?

    Justice from a kolwestan? No amount of cheating by Sata’s government will ever earn any support from any sincere Lozi, at least not after his stupidity of trashing Dr Chongwe’s COI which he himself appointed to get people’s views to help him make a proper decision! I now believe these CIOs are a big waste public resources by this good-for-nothing president! Shame on all of us who voted for him! I totally support Sakala’s idea of federalism as an alternative to governing this country in order to put an end to this tribalism killing our country.Federalism is a good subject for debate!

    Judge Chishimba has also dismissed the Kasenengwa Petition with costs and this is from Eastern Province. Kalima is officially the duly elected MP

    Even if lungwngwa lost,PF can not win a bye election in western province with the Barotse Saga going. Its only in eastern province were the petioners willbe winning because thats were PF have chance of winning bye elections

  16. Taj  February 29, 2012 at 15:42

    @ Republican guard you are very provocative are you not tired of un productive tribal wars? Judge Chishimba is learned Judge not a tribalist like you and your fellow bloggers. Any reasonable Judge would have given the same verdict because of the facts at hand. it is our law not a particular Judge pliz be civilised.

  17. Brian Bwalya  February 29, 2012 at 15:23

  21. deliverer  February 29, 2012 at 14:22

    There is no need to salute sata but judge Chishimba and the Zambian law, for a verdict against pf. Somtimes I WONDER HOW SOME PEOPLE THINK, ITS LIKE THEY ARE EVER DRANK. If sata should be a helo in these pertitions he should have discontinued his petitioners from going ahead yet he believes some will win so that we can have by-elections hoping he would win and ganner majority in parliament. Zambian judges are waking up to genuine discharge of justice as compared to how corrupt they were in the past.

  22. chayuma sana  February 29, 2012 at 14:13

    Where they do not have chance they seem not 2 interfear, this is a wel planned petitions to make believe that they lost some. This is gospel, truth watch my space

  23. Chipolopolo  February 29, 2012 at 13:50

    No amount of interference would ve changed things there . Stop commending where it is not due . Lungwangwa has white washed . Tortured , beaten ,humiliated , suffocated , hammered ,panel beaten patriotic front .

    Real zambian,

    You really make PF appear ugly! I wonder how you look like. What has this article got to do with Tongas. If you have no cows, its not their problem! Let not your envy destroy you. Tone down. You mean you cant see that even PF is no longer interested in your insults and let alone such behaviour? Anyway, cant blame you, may be its your culture.

  26. Republican Guard  February 29, 2012 at 13:37

    It was Judge Chishimba? Aren’t any of the tribalist taking note of that.

    @ Real Zambia. who are you referring to as ” people who chase cows”. It is clear that you mean Tongas. Tell me, what have the Tongas done to you to deserve such insults. you are the guys bringing up tribalism. Stop it!!! Just debate or put your arguments across in reference to the watchdog article. May God bless you.

  31. Real zambian  February 29, 2012 at 13:22

    Good move, although am PF supporter to be flank the courts are now working independentely under PF.so far PF have lost more than 3 petitions and no one has complained, i hope next time when the outcome would be in favour of PF, our brothers who chase cows day and night won’t complain, it’s like they are confused with the feaces that comes out from the cows, you know cows produces green stinking stuff from the ass which can make someone go mad. but with them it’s business as usual. but i have ka girl friend from this place, the boobs are good, pin pointend cause of sucking fresh milk straight from the bull or is it from the female?

  34. electrol  February 29, 2012 at 13:11

    I for one as an individual, I think petitions are a total waste of time.Zambia has a lot of urgent things to attend to. With due respect to the human fundamental rights about, right to appeal, education etc…In this case, lets concentrate on developmental programmes. God bless Zambia.
